Terms and conditions

The following terms and conditions regulate the sale of products by Maryamado Società Agricola S.r.l. (referred to henceforth as Maryamado for brevity) through the website www.maryamado.com. All purchase agreements entered into between the seller and the client through the aforementioned website and according to the procedures indicated here will be regulated by these terms and conditions (in accordance with Italian law and in particular Legislative Decree 70/2003 relating to e-commerce and Legislative Decree 206/2005 with specific reference to the legislation on remote sales contracts). Any changes to these terms and conditions will be promptly reported to the Client, and will be effective from the moment of their publication on the website and applied only to sales which have been completed after publication.

Acceptance of Terms and Conditions

The agreement between Maryamado and the Client is considered to commence with Maryamado’s acceptance of the order. Acceptance is implicit, unless otherwise communicated to the Client. By placing an order through one of the various possible methods, the Customer claims to have read the information provided during the purchasing process and accept the terms and conditions included below. The Client is therefore advised to carefully read these terms and conditions and to print or save them on another accessible and durable medium.

Purchasing Conditions

The Client may purchase only products available on the website www.maryamado.com by placing the order as described in the relevant factsheets. The information supplied with the products may be subject to variation; Maryamado reserves the right to modify the products’ information without prior notice. Images on the website are provided to the Client to facilitate the products’ visual recognition; due to variations in packaging, the photos may not reflect the exact appearance of the delivered product. An e-mail to the Client will confirm Maryamado’s correct receipt of the order, and will be sent to the e-mail address supplied by the Client. This confirmation message will contain the date and time of the order’s receipt and an "Order Number", to be used in any further communication with Maryamado, as well as in reference to these terms and conditions. In the case the order is not accepted, Maryamado guarantees a prompt notification will be sent to the Customer. All prices on the website are intended as retail prices and include VAT. Maryamado reserves the right to change prices at any time, without prior notice. The retail prices do not include any other taxes and duties applicable in the goods’ country of destination and/or services where this differs from Italy. These costs, which differ from country to country, are charged to the client, who is responsible for verifying the amount with the appropriate customs authorities.

Terms of Payment

The Customer may purchase products on the website www.maryamado.com using different forms of payment, as indicated in the purchasing process. Any additional costs relating to a specific method of payment will be explicitly indicated during the purchasing process..

Terms of Delivery

Maryamado products are delivered through specialised couriers. In general, the cost of shipping is charged to the client and explicitly indicated at the time the order is placed. Depending on the goods’ destination area, deliveries may occur over a period of time ranging from 24 hours to 30 days in relation to the country of destination and with the exception of unforeseen circumstances. Upon receipt of the goods, the Client is obliged to verify their integrity and if the client has doubts about such, it must be indicated on the delivery receipt. The customer will have 14 business days to check the integrity of the goods and communicate any damage in writing to the e-mail address shop@maryamado.com. Maryamado will refund the customer within 14 business days.

Return Policy

The Client has the right to terminate the agreement, without specifying the reason or reasons, within 14 days. The termination period expires 14 days after the day the Client or a third party, other than the courier and the designated Client, acquires physical possession of the goods. To terminate the agreement, the Customer is required to inform Maryamado of the decision to terminate by means of an explicit declaration sent to the contact information listed above (for example: a physical letter sent by post, a fax, or an e-mail). To meet the termination deadline, the Client must send the communication regarding the termination before the termination period has expired. With the termination of this agreement, the Client will be reimbursed for all payments made to Maryamado, including delivery costs (with the exception of additional costs resulting from the possible choice of delivery options costing more than the least expensive standard delivery offered), without undue delay and in any event, no later than 14 days from the day Maryamado is informed of the Client's decision to terminate this agreement. Refunds will be made using the same payment method the Client used for the initial transaction, unless the Client has expressly stipulated otherwise; in any event, the Client will not incur any costs as a consequence of this reimbursement. The refund may be paused until the goods have been received or until the Client can give proof the goods have been returned via courier, whichever is earlier. The Client is requested to return the goods and have them delivered to Maryamado without undue delay and within 14 days from the date the termination of this agreement was communicated. The deadline has been met if the Client sends back the goods before the end of the 14-day period. The Client will be responsible for the cost of returning the goods. The Client will be responsible for the decrease in the value of the goods resulting from handling the goods outside of what is necessary to establish the goods’ quality, characteristics, and functionality. Damaged or used products, even if only partially so, will not be replaced or refunded. The right to terminate the agreement does not apply to: custom-made products and goods; goods that have been personalised; goods that will expire or deteriorate rapidly; goods that are sealed and not suitable for returns due to hygienic reasons; or sealed goods that have been opened after delivery.

European Online Dispute Resolution

Maryamado informs the user, in the role of “Client”, pursuant to art. 3, paragraph 1, lett. a) of the Consumer Code, that a European platform has been established for online resolution of consumer disputes (ODR platform). The ODR platform can be found at the following link https://ec.europa.eu/consumers/odr/main/?event=main.home.show. 
The Client will be able to consult a list of ADR (Alternative Dispute Resolution) entities through the ODR platform and find links to each website in order to start an online resolution procedure regarding the dispute..

Guarantee

In the event of the Products' lack of conformity, the Client must immediately contact Client Relations as indicated. The legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code apply to the sale of Products in the event that the Client is a "consumer or user" as defined in art. 3, paragraph 1, lett. a), of the Consumer Code, otherwise the rules of the civil code relating to the sale will apply. The Client has the right, by choice and on the condition that the type of Product allows it, to restore conformity of the Product by repairing the goods or replacing them, without incurring costs, or to an adequate price reduction or termination of the agreement. In any event, it is understood that it is the Client's responsibility, under penalty of forfeiture, to prove the date of the defect’s discovery and to provide all the elements necessary to identify this defect.

Privacy

Personal data requested when placing the order is collected by Maryamado and processed electronically, in order to satisfy obligations arising from the agreement the Client has entered into and will not, in any case and for any reason, be transferred to third parties. Maryamado guarantees its clients compliance with the legislation on processing personal data, governed by the privacy code referred to in the Legislative Decree. N. 196 of 30.06.03. The data controller is Maryamado and is legally represented, unless someone else is appointed pursuant to art. 29 of Legislative Decree. n. 196/2003. The client has the right to withdraw consent, at any time, to the processing of personal data with written communication to be sent to Maryamado, at the address listed above. The client, pursuant to art. 7 of Legislative Decree no. 196/2003, has the right to access their data in the manner provided therein. Marketing communications will be sent only with explicit consent of the Client in conjunction with the consent to process and by sending the online registration form.

Protection of Minors

Maryamado does not sell products to minors under the age of 18.

Jurisdiction and Applicable Law

The sales agreement between the client and Maryamado is entered into in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from this remote sales agreement, the territorial jurisdiction (if the Client is a consumer) is the court within the Client’s township of residence; in all other cases, the territorial jurisdiction is exclusively the Court of Florence.
